Can't help but laugh at his way of blogging it, but its still pretty crazy.

On a lighter note though he apparently raised the money via donations already.

Ironically enough, if FJ goes through with the lawsuit, he will only defame himself more since oatmeal is sending the money from the fundraiser to the cancer and wildelife charities. Clever move on oatmeal's part.

cause he didnt care, lol at the time he sent FJ an email saying hey gais you have my stuff take it off. then they said sorry bro, its user submitted, not our problem. oatmeal said K. now FJ sent this BS and he was like you are suing me for hosting my own comic, when you are hosting my comic illegally.

However, technically they weren't hosting it illegally. The supreme court ruled that site owners are not responsible for user uploaded content unless they fail to remove copyrighted material when ordered to.

Since Oatmeal never actually sent takedown notices, FJ may have some legal ground to stand on.

Is this a case of severe internet butt-hurt? Sure. It's a fucking retarded lawsuit. The sad thing is people win fucking retarded lawsuits all the time.

Basically they can argue "The Oatmeal slandered FJ when they accused us of stealing content. Since they never sent us DCMA notices, we had no legal obligation to remove user submitted content, thus never infringed on anything. His attacks on us have rippled throughout the internet and have caused harm to our name, brand, etc. This is why we're asking for $20,000 in damages".

Sounds stupid as fuck, but it's not if you think about it from a legal POV. Not that the Oatmeal dude is going to have any problem paying if a civil suit finds him guilty.

And FJ is making money from advertising. They aren't selling the work. If that were the case, sites like Reddit, Imgur, and 4Chan would be sued to hell.
